1. Eligibility: This Campaign is only open to those who register on the offer website and are 18 years or older on the day of registration. If you have won an offer or taken advantage of another Portraits by Marcelo Valente offer, special or promotion within the last 365 days, you will not be eligible to win. The Campaign is open to residents only. of Brazil and is void where prohibited by law. Employees of Retratos por Marcelo Valente, its affiliates, subsidiaries, advertising and promotion agencies and suppliers (collectively, the "Employees") and immediate family members and/or those who live in the same household as Employees are not eligible to participate in the Campaign.
2. Rules Agreement: By participating, the entrant ("You") agrees to be fully, unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements. Furthermore, you agree to accept the decisions of Portraits by Marcelo Valente as final with regard to the content of this Campaign.
3. Campaign Period: Entries will be accepted online. All online entries must be received for entries closed at 3:00 pm on March 20, 2022.
4. How to participate: To participate in the campaign, you must register by filling in the data in the online form provided on the offer's website. Entry must meet all Campaign requirements, as specified, to be eligible to win a prize. Incomplete entries or entries that do not comply with the rules or specifications may be disqualified at the sole discretion of Portraits by Marcelo Valente. You can only login once. You must provide the requested information. You cannot sign up more times than indicated using multiple email addresses, identities or devices to try to circumvent the rules. If you use fraudulent methods or try to circumvent the rules, Your submission may be removed from eligibility, at the sole discretion of Portraits by Marcelo Valente.
5. Prizes: The Grand Winner of the Campaign (the “Winner”) will receive a Portrait Session featuring a 35's Work of Art centimeters to your home. Actual / assessed value may differ at time of award. The specifics of the award will be determined exclusively by Portraits by Marcelo Valente. No cash or other prize substitution will be allowed, except at the discretion of Portraits by Marcelo Valente. Prize cannot be used for frames. Prize is not transferable. No substitution of prize or transfer/attribution of prize to other persons or the request of a cash equivalent by the Winner is permitted. Frames are not included in the prize. Acceptance of the prize constitutes permission for Portraits by Marcelo Valente to use the Winner's name, image and entry for advertising and commerce purposes without further compensation, unless prohibited by law.
6. Chances: The odds of winning depend on the total number of eligible entries received.
7. Selection and Notification of Winner: The winner will be selected under the supervision of Portraits by Marcelo Valente. The winner will be notified by phone, whatsapp, sms, mail and/or email within fifteen (15) days after selection of the winner. Weekly prize winners are drawn. Retratos por Marcelo Valente will not be responsible for the Winner's failure to receive notices due to spam, junk mail or other security settings or for the Winner providing incorrect or non-functioning contact information. If the Winner cannot be contacted, is not eligible, does not claim the prize within 10 days from the time notification is sent, or fails to timely return a completed and executed and released declaration as necessary, the prize may be lost and an alternate winner selected. The Winner's receipt of the prize offered in this Campaign is conditioned on compliance with any and all federal, state and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY THE WINNER (IN THE SOLE DISCRETION OF PORTRAITS BY MARCELO VALENTE) WILL RESULT IN THE WINNER'S DISQUALIFICATION AS A WINNER OF THE CAMPAIGN, AND ALL PRIVILEGES AS A WINNER WILL BE IMMEDIATELY CANCELED
8. Scheduling and Rescheduling Portrait Sessions: Our team and artists reserve exclusive studio time to provide you with our best personalized service while creating your family's artwork. So that we can accommodate you with the level of service you deserve, a refundable deposit for the reservation of the portrait session, in the amount of R$ 250.00, will be requested when booking the session time. This deposit is FULLY REFUNDED on the day of the session. In case of "no show", or cancellation of the session, the deposit will not be refunded and the prize may be forfeited, at the discretion of the studio Retratos por Marcelo Valente. Reschedulings can be made as many times as necessary, within 3 months of the first appointment, and provided that the studio is communicated more than 10 days in advance of the session, the deposit will not be charged again and this will serve to guarantee the new date.
9. Loss of prize due to lack of scheduling. Not all winners withdraw their prizes by scheduling their sessions and we understand that it may be something that is not of interest even if you won. We noticed that after the first week the amount of rewards redeemed dramatically decreases, so after 10 days of communication, if the portrait session has not been scheduled a new family will be selected. We've had such a positive response recently that we feel it's only fair for people who didn't win to get another chance.
10. Rights Granted by You: By participating in this campaign (eg photo, video, text, etc.), you understand and agree that Portraits by Marcelo Valente, anyone acting on behalf of Portraits by Marcelo Valente, and Portraits by licensees Marcelo Valente, shall have the right, when permitted by law, to print, publish, transmit, distribute and use in any media now known or later developed, in perpetuity and throughout the world, without limitation, their entry, name, portrait, image , voice, Campaign statements and biographical information for news, advertising, information, commerce, publicity, public relations and promotional purposes. without any additional compensation, notice, review or consent. Optional wording for contests: By entering this content, you represent and warrant that your entry is for an original work of authorship and does not violate the intellectual property or proprietary rights of others. If your registration infringes another person's intellectual property right, you will be disqualified at the sole discretion of Portraits by Marcelo Valente. If the content of your entry is found to be in violation of any intellectual property rights or the intellectual property of a third party, you shall, at your sole expense, defend or resolve such claims. You will indemnify, defend and protect the studio Retratos por Marcelo Valente from and against any suit, claim, liability, loss, damage, costs or expenses that Retratos por Marcelo Valente may incur, suffer or be required to pay as a result of such actions. infringement or suspected violation of the rights of third parties.
11. Terms and Conditions: Portraits by Marcelo Valente reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Campaign in case of virus, bug, unauthorized human intervention, fraud or any other cause beyond the control of Portraits by Marcelo Valente, or affect the administration, security, justice or appropriate conduct of the Campaign. In this case, Portraits by Marcelo Valente may select the winner from all eligible entries received before and/or after (if appropriate) the action taken by Portraits by Marcelo Valente. Portraits by Marcelo Valente reserves the right, at its sole discretion, to disqualify any individual who tampers with or attempts to tamper with the registration process or the operation of the Campaign or the website or violate these Terms and Conditions. Pictures by Marcelo Valente has the right, in its sole discretion, to maintain the integrity of the Campaign, to void entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in addition to those allowed by campaign rules; or the use of bots, macros, scripts or other technical means to enter. Any attempt by a participant to deliberately harm any website or impair the legitimate operation of the Campaign may be a violation of civil and criminal law. If such an attempt is made, Retratos por Marcelo Valente reserves the right to request compensation to the fullest extent permitted by law. Portraits by Marcelo Valente reserves the right to cancel, cancel or invalidate any gift certificate already granted and deny service for any reason it deems necessary.
12. Limitation of Liability: By entering, you agree to release and exempt the Portraits by Marcelo Valente and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, directors from any liability, illness , injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, caused by negligence or not, from: (i) participant's participation in the Campaign and/or its acceptance, possession, use, or misuse of any prize or any part thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware or software or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or in the Promotion; (v) electronic or human error in administering the Promotion or processing entries.
13. Disputes: As a condition of participating in this Campaign, the participant agrees that any and all disputes that cannot be resolved between the parties, and the causes of action arising out of or related to this Campaign, will be resolved individually, without resorting to any form of collective action. In addition, in any dispute, under no circumstances will the participant be able to obtain prizes for, and hereby waive all rights to punitive, incidental or consequential damages, including reasonable attorneys' fees, except for the participant's actual expenses (ie, costs members to join this campaign). The participant also waives all rights for the damages to be multiplied or increased.
